Commissioned Documentation
Interpretation: The word “Document” also means document, plan, report, statement, assessment, procedure and the like.
BUILDER ASSIST shall provide to the Client the document described in the proposal letter.
Copyright in all documents provided by BUILDER ASSIST in connection with the project shall remain the property of BUILDER ASSIST unless otherwise noted. The Client alone shall have a license to use the document for the purpose of completing the project. The Client shall not use or make copies of such document in connection with any work that is not included in the Project.
If BUILDER ASSIST considers it appropriate to do so, will engage a consultant to assist BUILDER ASSIST in specialist areas.
Each document is made for the benefit of the Client to whom it is addressed, and no other person shall be entitled to rely on the document for any purposes whatsoever.
The liability of BUILDER ASSIST to the Client in respect of the project shall be limited to the cost of rectifying the works subject to the commission. The Client indemnifies and holds BUILDER ASSIST harmless against all claims, costs and demands (including negligence) in relation to the services provided by any third party, including a third party engaged by, or at the suggestion of BUILDER ASSIST.
The document will be issued as draft only prior to final payment for the client to review and make comment, one round of amendments to the document are included in the fee proposal.
The final document will only be issued once full payment has been received.
